Terms for Wonder Portrait Mini Sessions

This agreement is between:
You, as purchaser (hereinafter known as the “CLIENT”) of a Wonder Portrait Mini Session (hereinafter known as the “EVENT”) and Melanie Gordon (hereinafter known as the “PHOTOGRAPHER”)

COPYRIGHT: It is understood that the PHOTOGRAPHER owns the rights to the photographs generated from this job in accordance with Canadian Copyright Law (all rights reserved). The photographs may not be reproduced in any manner without the PHOTOGRAPHER’s explicitly written permission. The CLIENT shall not reproduce the digital proofs in any manner, including but not limited to screenshots of the online proof gallery. If the CLIENT has purchased digital files from the PHOTOGRAPHER, upon final payment by the CLIENT, the PHOTOGRAPHER will license the images purchased for the CLIENT to make prints for personal use only. If the CLIENT has purchased digital files from the PHOTOGRAPHER, the PHOTOGRAPHER grants the CLIENT permission to share the images on social networking websites, with family and friends, and on vendor websites as long as the images remain unaltered and textual credit is explicitly given to the PHOTOGRAPHER. These photographs shall not be let out for use by a Third Party, or in a business context, without the permission of the Photographer and the negotiation of an additional usage license and fee, at the Photographer’s discretion.

MODEL RELEASE:  The CLIENT hereby assigns the PHOTOGRAPHER the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction.  The CLIENT releases all claim to profits that may arise from use of images. The signing of this agreement also includes the model release for children under the age of 18 who are in the photographs and for whom the CLIENT is the legal guardian. ** Please contact me if you have questions about this.




CAPTURE AND DELIVERY:  The PHOTOGRAPHER is not liable to deliver every image taken at the session. The determination of images delivered to the CLIENT is left to the discretion of the PHOTOGRAPHER. Delivery of at least 20 proofs will be through a private online gallery approximately 2-3 weeks after the EVENT and will be online for 30 days for the CLIENT to make selections from for purchase. Products such as prints, albums or wall art may take longer for delivery. Purchased high resolution digital files will be delivered as 2400x3600px jpg files via digital download.

POST PRODUCTION AND EDITING:  The final post production and editing styles, effects, and overall look of the images are left to the discretion of the PHOTOGRAPHER. Any requests by the CLIENT for additional post production (such as changing an image from black and white to colour or other photoshop work) will require an additional fee. A mix of colour and black and white images will be delivered as proofs to the CLIENT unless otherwise requested in writing by the CLIENT before the scheduled EVENT.
